1. Introduction and Acceptance

Welcome to SOEGi, an AI-powered recruitment platform operated by SOEG Consulting (“SOEGi,” “we,” “us,” or “our”), accessible at soegjobs.com. These Terms of Use (“Terms”) constitute a legally binding agreement between you and SOEGi.

By accessing or using the SOEGi platform, creating an account, uploading a resume, posting a job, or engaging with our services in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must immediately discontinue use of the platform.

These Terms apply to all users, including but not limited to:

  • Candidates Job seekers creating profiles and applying for positions
  • Employers Hotels, restaurants, and hospitality businesses posting jobs and accessing candidate profiles
  • Visitors Individuals browsing the platform without creating an account

2. Eligibility and Account Registration

2.1 Age and Legal Capacity

You must be at least 18 years of age to use SOEGi. By using the platform, you represent and warrant that you have the legal capacity to enter into a binding contract under applicable law.

2.2 Account Creation

To access certain features, you must create an account by providing accurate, current, and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring your account information remains accurate and up to date

2.3 Employer Verification

Employers must represent legitimate hospitality businesses registered in India or other jurisdictions where SOEGi operates. We reserve the right to request business verification documents, including business licenses or incorporation certificates.

2.4 Account Suspension or Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the platform, with or without notice.

3. Platform Services and AI Technology

3.1 Service Description

SOEGi provides an AI-powered recruitment platform specifically designed for the hospitality industry. Our services include:

  • AI-driven candidate-job matching using proprietary algorithms
  • Resume parsing and skills extraction
  • Job posting and distribution services
  • Candidate profile database access for employers
  • Application tracking and communication tools

3.2 AI Matching Technology

Our AI matching system analyzes candidate profiles, resumes, and job requirements using machine learning algorithms. While we strive for accuracy, the AI-generated matches are recommendations only and should not be the sole basis for hiring decisions.

Important: SOEGi does not guarantee job placements, interview opportunities, or hiring outcomes. All hiring decisions remain the sole responsibility of employers.

3.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of services.

4. User Obligations and Prohibited Conduct

4.1 Candidate Obligations

Candidates agree to:

  • Provide truthful, accurate, and complete information in resumes and profiles
  • Only upload documents and content they have the right to share
  • Not misrepresent qualifications, work experience, or educational credentials
  • Respond professionally to employer communications
  • Not create multiple accounts to circumvent platform limitations

4.2 Employer Obligations

Employers agree to:

  • Post only legitimate job opportunities with accurate descriptions and requirements
  • Comply with all applicable employment laws, including anti-discrimination regulations
  • Use candidate information solely for legitimate recruitment purposes
  • Not discriminate based on caste, religion, gender, disability, or other protected characteristics
  • Maintain confidentiality of candidate information accessed through the platform
  • Not harvest or scrape candidate data for unauthorized purposes

4.3 Prohibited Activities

All users are strictly prohibited from:

  • Posting fraudulent, misleading, or deceptive content
  • Uploading malware, viruses, or harmful code
  • Attempting to gain unauthorized access to platform systems
  • Scraping, harvesting, or extracting data through automated means
  • Reverse engineering or decompiling platform technology
  • Using the platform for any unlawful purpose
  • Harassing, threatening, or abusing other users
  • Posting content that violates intellectual property rights
  • Circumventing security measures or access controls
  • Creating fake profiles or impersonating others

5. Content Ownership and Intellectual Property

5.1 Platform Intellectual Property

All content, features, functionality, and technology on SOEGi, including but not limited to text, graphics, logos, software, AI algorithms, databases, and design elements, are owned by SOEGi or its licensors and are protected by Indian and international copyright, trademark, and intellectual property laws.

5.2 User-Generated Content

By uploading resumes, job postings, or other content to SOEGi, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, distribute, display, and process such content for the purpose of operating and improving the platform.

You retain ownership of your content but represent and warrant that:

  • You own or have necessary rights to the content you upload
  • The content does not violate any third-party rights
  • The content is accurate and not misleading

5.3 AI Training and Data Use

Aggregated, anonymized data from platform usage may be used to improve our AI algorithms and services. Personal information will only be used in accordance with our Privacy Policy.

6. Payment Terms (Employer Services)

6.1 Paid Services

Certain employer features, including job postings, candidate database access, and premium services, require payment. All fees are displayed in Indian Rupees (INR) and are exclusive of applicable taxes unless stated otherwise.

6.2 Payment Processing

Payments are processed through third-party payment gateways powered by Emly Labs (our tech partners). By making a payment, you agree to the payment processor’s terms and authorize us to charge the specified amount. All transactions are GST-compliant as per Indian tax regulations.

6.3 Refund Policy

All fees are non-refundable except as required by applicable law or as explicitly stated in the service agreement. Refund requests must be submitted within 7 days of payment with valid justification.

6.4 Subscription Renewals

Subscription-based services will automatically renew unless cancelled before the renewal date. You are responsible for cancelling subscriptions through your account settings.

7. Privacy and Data Protection

Your use of SOEGi is also governed by our Privacy Policy, which details how we collect, use, store, and protect your personal information. By using the platform, you consent to our data practices as described in the Privacy Policy.

7.1 Data Security

While we implement industry-standard security measures to protect user data, no system is completely secure. You acknowledge that you provide information at your own risk.

7.2 Data Retention

Inactive accounts (no login activity for 180 consecutive days) may be subject to data archival or deletion as per our data retention policy. Users will be notified before any permanent deletion of account data.

7.3 Candidate Data Protection

Employers accessing candidate information through SOEGi agree to:

  • Use candidate data only for legitimate recruitment purposes
  • Not share, sell, or distribute candidate information to third parties
  • Comply with applicable data protection regulations
  • Delete candidate data when no longer needed for recruitment purposes

8. Disclaimers and Limitation of Liability

8.1 Service “As Is”

SOEGi is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 No Employment Guarantee

SOEGi does not guarantee:

  • Job placements or employment outcomes for candidates
  • Quality or suitability of candidates for employers
  • Accuracy of AI-generated matches or recommendations
  • Uninterrupted or error-free platform access

8.3 Third-Party Content

We are not responsible for content posted by users, including job postings, resumes, or communications. Users are solely responsible for their interactions with other users.

8.4 Limitation of Liability

To the maximum extent permitted by law, SOEGi and its officers, directors, employees, and agents shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from user reliance on platform content or AI recommendations
  • Damages exceeding the amount paid by you to SOEGi in the 12 months preceding the claim
Employment Relationships: SOEGi is a platform facilitating connections between candidates and employers. We are not a party to any employment relationship, contract, or dispute that may arise between users.

9. Indemnification

You agree to indemnify, defend, and hold harmless SOEGi, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your use or misuse of the platform
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Content you submit to the platform
  • Employment disputes or relationships formed through the platform

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

10.2 Jurisdiction

Any disputes arising from or relating to these Terms or your use of SOEGi shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

10.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified through:

  • Email notification to registered users
  • Prominent notice on the platform
  • Updated “Last Modified” date at the top of this document

Continued use of SOEGi after modifications constitutes acceptance of the updated Terms. If you do not agree to the changes, you must discontinue use of the platform and may request account deletion.

12. Termination

12.1 Termination by User

You may terminate your account at any time by contacting us at support@soegjobs.com. Upon termination, your account and associated data will be deactivated, subject to our data retention policies.

12.2 Termination by SOEGi

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms or our policies
  • Engage in fraudulent or illegal activity
  • Abuse or harass other users
  • Remain inactive for 180 consecutive days without prior notice

12.3 Effect of Termination

Upon termination, your right to access and use the platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect, including intellectual property rights, disclaimers, indemnification, and dispute resolution clauses.

13. Compliance with Laws

Users must comply with all applicable local, state, national, and international laws, including:

  • Employment Laws: Equal Employment Opportunity regulations, anti-discrimination laws, wage and hour laws
  • Data Protection: Information Technology Act, 2000, and Digital Personal Data Protection Act, 2023 (when enacted)
  • Anti-Fraud: Prohibition of misleading advertisements and fraudulent job postings
  • Tax Compliance: GST and other applicable tax regulations for paid services

14. Miscellaneous Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SOEGi regarding use of the platform.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.

14.5 Force Majeure

SOEGi shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or technical failures.

14.6 Language

These Terms are provided in English. Any translation is for convenience only. In case of conflict, the English version shall prevail.
